Title: ●Hazardous Materials: Adjustment of Maximum and Minimum Civil Penalties | |
Abstract: This direct final rule would adjust the maximum and minimum civil penalties for a knowing violation of the Federal hazardous materials transportation law or a regulation, order, special permit, or approval issued under that law in accordance with the requirements of the Federal Civil Penalties Inflation Adjustment Act of 1990 as amended by the Debt Collection Improvement Act of 1996 which requires that the penalties be adjusted periodically to consider the effects of inflation. The maximum civil penalty is increased to $55,000 and to $110,000 for a violation that results in death, serious illness, or severe injury or substantial destruction of property. The minimum civil penalty is increase to $275 and to $475 for a violation related to training. | |
