Title: Revised Regulations for Concentrated Animal Feeding Operations (CAFOs) in the Chesapeake Bay Watershed 
Abstract: EPA and authorized states administer the National Pollutant Discharge Elimination System (NPDES) program for concentrated animal feeding operations (CAFOs), as revised by nationally-applicable rules in 2003 and 2008. On May 12, 2009, President Barack Obama issued Executive Order 13508 on Chesapeake Bay Protection and Restoration. Agriculture is the single largest contributor of nitrogen, phosphorus, and sediment pollution to the Chesapeake Bay Watershed. Manure is the source of about half of the nutrient loading from agriculture. As directed under the Executive Order, EPA developed a strategy, in consultation with the States and key stakeholders, for protecting water quality in the Chesapeake Bay. The proposed action might establish broader regulatory authority in the Bay and additional requirements for manure management for CAFOs in the Bay. Consistent with the draft joint federal strategy, the scope of the proposed rule may consider expanding the universe of CAFOs and requiring more stringent standards for permits (e.g. better nutrient management planning). Additionally, options for a streamlined designation process of smaller facilities as CAFOs and better off-site manure management may be considered for the Bay or nationally. During the rulemaking process, EPA will consider how effectively Chesapeake Bay states strengthen their pollution control programs to achieve the reductions in nutrient and sediment pollution needed to meet Bay water quality standards. The Chesapeake Bay CAFO Rule is being developed to ensure Regional and State Water NPDES Permitting Authorities have sufficient tools to reduce discharges of manure from these facilities.
