Title: Protection of Stratospheric Ozone: Amending Requirements To Import Ozone-Depleting Substances for Destruction in the U.S. | |
Abstract: EPA is proposing to revise the requirements for import of Class I and Class II controlled ozone-depleting substances (controlled substances) into the United States by streamlining provisions for importing controlled substances specifically for purposes of destruction. The proposed provisions would no longer require used imports for destruction to abide by the petition process but instead require a more efficient pre-notification process to EPA in the form of a certification of intent to import for destruction for all imports for destruction--both used and virgin. The regulation would revise associated recordkeeping and reporting requirements for persons who import controlled substances for destruction--replacing an existing set of requirements with a new, more effective set of requirements. EPA is also proposing to revise the regulations governing the destruction of controlled substances under 40 CFR part 82, subpart A, by revising the definitions governing destruction of controlled substances and revising recordkeeping and reporting requirements for persons who destroy controlled substances. While overall burden for respondents will increase, this is due to the additional participants that EPA expects will take advantage of the new regulatory process by importing additional controlled substances for destruction. If there were no additional respondents projected to participate in the import process, overall burden to respondents would decrease. EPA believes that the streamlined regulatory provisions being proposed for importers would ease overall burden, encouraging more imports into the United States for responsible destruction, and thus would result in the destruction of additional quantities of controlled substances in the United States that would have otherwise been emitted into the atmosphere, where they deplete the stratospheric ozone layer. | |
