Title: Testing of Certain Hazardous Air Pollutants (HAPs) | |
Abstract: The 1996 proposed Test Rule for Hazardous Air Pollutants proposed to require manufacturers and processors of 21 hazardous air pollutants (HAPs) to test their chemicals for certain health effects. EPA also solicited proposals for Enforceable Consent Agreements (ECAs) regarding the performance of pharmacokinetics studies which would permit extrapolation from oral data to predict risk from inhalation exposure. The data would have primarily been used to implement several provisions of section 112 of the Clean Air Act (CAA), including determining residual risk, estimating risks associated with accidental releases of chemicals, and determining whether or not substances should be removed from the CAA section 112(b)(1). EPAs Office of Air Quality Planning and Standards (OAQPS), along with EPAs Office of Research and Development (ORD), informed EPA that it would not be prudent to expend resources to finalize this rule. EPA is also withdrawing this proposed action because the original proposal was issued in 1996 and the Agency has determined that the record does not address recent scientific information developed since the original proposal. This withdrawal, however, does not preclude the Agency from initiating the same or similar rulemaking at a future date. EPA is currently developing efforts to strengthen the agencys chemical management program under Toxics Substances Control Act (TSCA) by ramping up efforts to assess, prioritize, and take action on existing chemicals. As part of this enhanced effort EPA will consider how best to address potential concerns with these chemicals, which would include using scientific information and data developed since the rule was proposed. | |
