Title: Mercury Export Ban Act (MEBA); Essential Use Exemption Instructions | |
Abstract: The Mercury Export Ban Act of 2008 amended section 12 of the Toxics Substances and Control Act (TSCA) to prohibit the export of elemental mercury from the United States effective January 1, 2013. The new provision in TSCA allows any person residing in the U.S. to petition the Administrator for an exemption to the export ban. If the Administrator makes certain findings listed in the Act, the Administrator may grant exemptions to the ban through notice and comment rulemaking. Through a posting on the Web site, EPA will provide the basic instructions and information related to these exemptions. Exemption requests themselves will be acted on through separate rulemakings that will be covered by a separate entry in the Regulatory Agenda, as appropriate. | |
