Title: ●Clear Title Protection for Purchasers of Farm Products
Abstract: GIPSA is proposing to amend the Clear Title regulations under section 1324 of the Food Security Act of 1985, as amended (Act) to comply with the Food, Conservation, and Energy Act of 2008 (2008 Farm Bill). Specifically, we are proposing to allow a State that implements a central filing system for notification to the public of liens on farm products under the Clear Title Program to; maintain a master debtor list with social security numbers or Internal Revenue Service (IRS) taxpayer identification numbers that have been encrypted for security purposes; provide a method by which a search of the encrypted social security and IRS tax identification numbers may be conducted to determine whether the farm product at issue is subject to one or more liens, and distribute electronically the master list with encrypted social security and IRS taxpayer identification numbers.
