Title: Emergency Supplemental Nutrition Assistance for Victims of Disasters Procedures 
Abstract: The purpose of the proposed regulation is to establish procedures for the delivery of the Disaster Supplemental Nutrition Assistance Program (D-SNAP) by State agencies. The Food and Nutrition Act of 2008 (FNA) provides authority for the Secretary of Agriculture to establish temporary emergency standards of eligibility for the duration of an emergency for households who are victims of a disaster that disrupts commercial channels of food distribution. The interim D-SNAP regulations at 7 CFR part 280.1 do not expand substantially upon the D-SNAP section of the Food and Nutrition Act. In order to provide detailed guidance to State agencies as they plan, operate, and assess their D-SNAP operation, Food and Nutrition Service (FNS) in 1995 developed the "Disaster Supplemental Nutrition Assistance Program Guidance," which provides policy guidance to State administering agencies for all phases of program operations. A 2007 Office of Inspector General (OIG) report (Audit 27099-49-Te: Disaster Food Stamp Program for Hurricanes Katrina and Rita--Louisiana, Mississippi, and Texas--Final Report) found some deficits in the design and review of State D-SNAP plans of operation and inadequate controls to prevent recipient fraud and duplicate participation. OIG attributed the deficits, in part, to a lack of detailed procedures in regulations and, in response, required FNS to amend D-SNAP policy on those specific topics and to promulgate D-SNAP regulations. In order to provide detailed guidance to State agencies operating D-SNAP and to address OIG concerns, FNS plans to publish a Proposed Rule for D-SNAP that will codify longstanding policies from the "Disaster Supplemental Nutrition Assistance Guidance" and policy changes required by the OIG audit (09-012).
