Title: Retirement Eligibility for Customs and Border Protection Officers Under CSRS and FERS 
Abstract: The Office of Personnel Management (OPM) will amend parts 831, 841, and 842 of title 5, Code of Federal Regulations, to reflect changes in the retirement benefits available to customs and border protection officers under the Civil Service Retirement System (CSRS) and the Federal Employees' Retirement System (FERS). These rules incorporate amendments to CSRS and FERS retirement law pursuant to section 535 of the Department of Homeland Security Appropriations Act, 2008 (Pub. L. 110-161, 121 Stat. 2042). The Act provides early retirement and enhanced annuity benefits for customs and border protection officers employed by the United States Department of Homeland Security under CSRS and FERS; requires an increase in the percentage rate of withholdings from the basic pay of customs and border protection officers; and establishes mandatory retirement of customs and border protection officers at age 57. Section 535 of Division E (the Department of Homeland Security Appropriations Act, 2008) of the Consolidated Appropriations Act, 2008, Public Law 110-161 (approved December 26, 2007), enacts new human capital management provisions applicable to specified Customs and Border Protection (CBP) Officers. In addition to the provisions that will be continuing and that will apply to individuals employed by CBP on its effective date, section 535 also includes unique provisions applicable only to individuals who are CBPOs on its effective date. The law prescribed that "Any regulations necessary to carry out the amendments made by this section shall be prescribed by the Director of the Office of Personnel Management in consultation with the Secretary of Homeland Security."
