Title: Removing Regulation Excluding U.S. Captive-Bred Scimitar-Horned Oryx, Addax, and Dama Gazelle From Certain Prohibited Activities
Abstract: We will finalize our proposed rule to revise the ESA regulations by removing paragraph (h) of 50 CFR 17.21. This action would eliminate the exclusion of U.S. captive-bred live wildlife and sport-hunted trophies of scimitar-horned oryx, addax, and dama gazelle from certain prohibited activities, such as take and export, under the Act. This change is in response to a court order to consider permit applications on a case-by-case basis. The three species remain listed as endangered, and a person would need authorization under the current regulations at 50 CFR 17.21(g) or 50 CFR 17.22 to conduct any prohibited activities.
