Title: Risk and Technology Review for National Emission Standards for Hazardous Air Pollutants From the Pulp and Paper Industry 
Abstract: Section 112(f)(2) of the Clean Air Act (CAA) directs EPA to conduct risk assessments on each source category subject to maximum achievable control technology (MACT) standards and to determine if additional standards are needed to reduce residual risks, to be completed 8 years after promulgation. Section 112(d)(6) of the CAA requires EPA to review and revise the MACT standards as necessary, taking into account developments in practices, processes, and control technologies, to be done at least every 8 years. The National Emission Standards for Hazardous Air Pollutants (NESHAP) for the Pulp and Paper Industry (subpart S) was promulgated in 1998 and also has not been reviewed. This action will propose those amendments.

Statement of Need: The National Emission Standard for Hazardous Air Pollutants (NESHAP) in the Pulp and Paper Category was promulgated April 15, 1998 and codified as subpart S in 40 CFR parts 63.440 to 63.459. Section 112(f)(2) of the Clean Air Act (CAA) directs EPA to conduct risk assessments on each source category subject to maximum achievable control technology (MACT) standards, and to determine if additional standards are needed to reduce residual risks, to be completed 8 years after promulgation. Section 112(d)(6) of the CAA requires EPA to review and revise the MACT standards as necessary, taking into account developments in practices, processes and control technologies, to be done at least every 8 years.

Summary of the Legal Basis: EPA has signed a consent agreement that directs it to propose a Risk and Technology Review rule (RTR) to address the requirements of Sections 112 (f)(2) and (d)(6) by December 15, 2011 and promulgate a final RTR rule for this category by July 31, 2012.
