Abstract: This rulemaking would clarify that paying a proposed civil penalty in full in response to a Notice of Claim would not allow respondents to unilaterally avoid an admission of the violations charged under part 386.18(c) of FMCSA´s Rules of Practice. This rulemaking would also implement procedures for placing carriers who have "reincarnated," or attempted to evade a history of violations by starting a new company, out-of-service. | |
