The agency had tentatively concluded that the original safety problem the standard was intended to address no longer exists. There has not been a compliance issue with this standard since shortly after it became effective. Additionally, we had tentatively believed that other vehicle safety standards are in place to prevent the safety concern addressed by FMVSS No. 219. After careful consideration of comments received to the NPRM and the potential safety impact of new entrants to the vehicle fleet, NHTSA has decided to withdraw this deregulatory action.
