Title: Confidentiality of Medical Quality Assurance Records; Qualified Immunity for Participants | |
Abstract: This proposed rule would implement section 805(j) of the Indian Health Care Improvement Act, as amended by the Affordable Care Act, requiring the Secretary, acting through the Indian Health Service, to promulgate regulations to make the medical quality assurance records of Indian health programs and urban Indian organizations confidential and privileged, with very limited exceptions. This section also prohibits the testimony of individuals who review or create medical quality assurance records, with very limited exceptions. | |
