The rulemaking would set forth an interpretation that clarifies that novelty helmets are within the reach of 49 USC 30102(a)(7), motor vehicle equipment. In addition, this rulemaking would propose preliminary screening requirements that could be used by laboratories, law enforcement, or Customs and Border Protection to identify helmets that are not designed to comply with FMVSS No. 218.
