Title: Requirements Pertaining to Third Party Conformity Assessment Bodies
Abstract: Section 14(a) of the Consumer Product Safety Act (CPSA), as amended by the Consumer Product Safety Improvement Act of 2008, requires the Commission to publish requirements for third party conformity assessment bodies to assess conformity with a children's product safety rule, and to maintain on its Web site an up-to-date list of Commission-accepted third party conformity assessment bodies. Section 14(e) of the CPSA provides that the Commission may withdraw or suspend its acceptance of a third party conformity assessment body. The Commission will be considering a rule that would (1) codify the requirements and procedures that a third party conformance body must meet to become a Commission-accepted third party conformity assessment body; (2) address how a third party conformity assessment body may voluntarily discontinue participation in the Commission's children's product assessment program; and (3) describe the grounds and procedures for withdrawal or suspension of Commission acceptance of a third party conformity assessment body. On March 14, 2012, staff submitted for Commission consideration a briefing package on a proposed rule. On April 27, 2012, the Commission voted unanimously to approve publication of the proposed rule in the Federal Register. The proposed rule published on May 24, 2012. The Comment period ended on August 7, 2012. Following review of the comments, staff will send to the Commission a briefing package on the final rule.
