Abstract: This advance notice of proposed rulemaking seeks input from States, other stakeholders, and the public to better understand the scope of any problems HIPAA may pose to states in their reporting to the National Instant Criminal Background Check System (NICS). On January 16, 2013, the President announced 23 executive actions aimed at curbing gun violence across the nation, including a specific commitment to "[a]ddress unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, that may prevent States from making information available to the background check system." | |
