Title: Petition CP 10-2/HP 10-1 Requesting a Change to the Bunk Bed Standard 
Abstract: Carol Pollack-Nelson of Independent Safety Consulting submitted a petition to the Commission on April 16, 2010, requesting that the Commission initiate rulemaking to revise existing regulations related to bunk beds. The petition was docketed under the Consumer Product Safety Act (CPSA) as Petition CP 10-2 and under the Federal Hazardous Substances Act (FHSA) as Petition HP 10-1. The petition requests that the Commission revise its existing bunk bed standard, codified at 16 CFR parts 1213, 1500, and 1513, to incorporate requirements for head and neck entrapment testing in spaces created by side structures that are provided with a bunk bed, including ladders. The petition was docketed on June 18, 2010. The Commission voted unanimously on June 29, 2010 to approve publication of a notice in the Federal Register seeking comments on the petition. The notice was published in the Federal Register on July 12, 2010. The comment period closed on September 10, 2010. On April 12, 2011, the Commission voted unanimously to defer the petition, pending an evaluation of progress by the voluntary standard committee to address the hazard. On November 8, 2011, the Commission voted unanimously to defer the petition for an additional six months in anticipation of action by the voluntary standard committee to address the hazard. On May 16, 2012, the staff sent a briefing package to the Commission that provided an update about the activities related to the voluntary standard. On May 22, 2012, the Commission voted unanimously to defer the petition for an additional six months in anticipation of action by the voluntary standard committee to address the hazard. CPSC staff will deliver a status update report to the Commission on the activities of the voluntary standard committee.
