Title: Toy Cap Requirements  
Abstract: Staff has determined that the toy cap requirements contained in F963-11 overlap existing requirements contained in 16 CFR 1500.18, 1500.47, and 1500.86. ASTM F 963-11 requires a more accurate measurement of sound levels that could result in hearing loss, and maximum sound levels in ASTM F 963-11 are equivalent or more stringent than those in 16 CFR part 1500. While the duplicate rules overlap, they do not conflict; products that meet the requirements in ASTM F 963-11 will also meet all the requirements in the CFR. The requirements in 16 CFR 1500.18, 1500.47, and 1500.86 require testing with equipment that is no longer available, and therefore, obsolete. Currently, toy caps are required to meet the ASTM F 963 requirement for third party testing. On June 13, 2012, staff submitted for Commission consideration a briefing package on the proposed rule, On June 19, 2012, the Commission voted unanimously to approve publication of the proposed rule in the Federal Register that would revoke the requirements in 16 CFR 1500.18, 1500.47, and 1500.86. The proposed rule was published on June 25, 2012. The comment period ended on August 24, 2012 and staff is preparing for Commission consideration a briefing package on the final rule.
