Abstract: Under the Medicare IVIG and Strengthening Medicare and Repaying Taxpayers Act (the SMART Act), this proposed rule would establish a right of appeal and an appeals process for applicable plans, with respect to Medicare conditional payments the Secretary seeks to recover from the applicable plan.
