Title: Pesticides; Satisfaction of Data Requirements; Minor Revisions to the Procedures to Ensure Protection of Data Submitters' Rights
Abstract: In January 2011, EPA proposed revisions to its regulations governing procedures for the satisfaction of data requirements under the Federal Insecticide, Fungicide, and Rodenticide Act, which are codified in 40 CFR part 152, subpart E. These provisions include, among other things, procedures for the protection of exclusive use and data compensation rights of data submitters. EPA proposed to update the regulations to accommodate statutory changes and changes in practice that have occurred since 1984; to make minor changes to clarify the regulations; and to make changes that would simplify the procedures and reduce burdens for certain data submitters. The proposal did not otherwise propose to make substantive changes to the requirements.
