Title: ●Tobacco Regulation for Substance Abuse Prevention and Treatment Block Grants | |
Abstract:
The current Synar regulation (45 CFR part 96 RIN 0930-AA01) requires that the Secretary may not make a Substance Abuse Prevention and Treatment Block Grant to a State ... unless the State has in effect a law prohibiting any manufacturer, retailer, or distributor of tobacco products from selling or distributing such products to any individual under the age of 18. However the Synar regulation does not define tobacco products. The 2009 Family Smoking Prevention and Tobacco Control act defines a tobacco product as (1) any product made or derived from tobacco that is intended for human consumption including any component part or accessory of a tobacco product (excluding raw materials other than tobacco used in manufacturing a component part or accessory of a tobacco product) and (2) does not mean an article that is a drug device or combination product as those terms are defined in the Food Drug and Cosmetic Act. The purpose of this proposed rule is to define tobacco products in the Synar regulation to be consistent with the definition in the 2009 Family Smoking Prevention and Tobacco Control Act. |
