Title: Qualified Financial Contracts | |
Abstract:
Section 210(c)(8)(H) of the Dodd-Frank Wall Street Reform and Consumer Protection Act (Act) requires the Federal primary financial regulatory agencies (Agencies) to jointly prescribe regulations requiring financial companies to maintain such records with respect to qualified financial contracts that the Agencies determine are necessary or appropriate to assist the Federal Deposit Insurance Corporation (FDIC) as receiver of a financial company in being able to: (1) exercise its rights under the Act; and (2) fulfill its obligations under paragraphs 210(c)(8), (9), and (10) of the Act. 12 U.S.C. 5390(c)(8)(H). The Act provides that if the Agencies do not prescribe joint final or interim final regulations by July 21, 2012, the Chairperson of the Financial Stability Oversight Council (FSOC) shall prescribe such regulations in consultation with the FDIC. Because the Agencies did not meet the statutory deadline, the Secretary of the Treasury, as Chairperson of the FSOC, intends to publish a proposed rule that would impose recordkeeping requirements on financial companies with respect to positions, counterparties, legal documentation, and collateral. The proposed rule will also differentiate among financial companies by taking into consideration factors such as their size and risk. |
