DOE is initiating this test procedure rulemaking pursuant to EPCA 42 U.S.C. 6314(a)(4)(B), as amended by the Energy Independence and Security Act of 2007 (EISA 2007), and the American Energy Manufacturing Technical Corrections Act (AEMTCA), which requires that the test procedure for commercial packaged boilers be amended as necessary to be consistent with the amended industry test procedure or rating procedure unless the Secretary determines, by rule, published in the Federal Register and supported by clear and convincing evidence, that to do so would not meet the requirements for test procedures described under 42 U.S.C. 6314(a)(2) and (3). This rulemaking will satisfy this statutory provision.
