Abstract:
Section 108 of the Consumer Product Safety Improvement Act of 2008 (CPSIA) prohibits certain phthalates in children's toys or child care articles. The CPSIA establishes a Chronic Hazard Advisory Panel (CHAP) to study the effects on children's health of all phthalates and phthalate alternatives as used in children's toys and child care articles. The CHAP must prepare a report and make recommendations to the Commission regarding phthalates identified in section 108 of the CPSIA and phthalate alternatives. No later than 180 days after receiving the CHAP's report, the Commission must promulgate a final rule pursuant to section 553 of the Administrative Procedure Act. The CHAP's report was received on July 18, 2014. In accordance with the direction in section 108 of the CPSIA, staff will prepare an NPRM briefing package for Commission consideration. |
