Title: ●Regulatory Flexibility Act Threshold | |
Abstract:
The Regulatory Flexibility Act (RFA) generally requires Federal agencies to determine and specially consider the impact of proposed and final rules on small entities. Under the RFA, NCUA has authority to define what credit unions qualify as small entities and receive special consideration in the rulemaking process. In 2013, the NCUA Board (Board) increased the threshold it uses to determine what credit unions were "small" for purposes of the RFA from $10 million to $50 million. The Board simultaneously committed to review the threshold within 2 years of the increase and every 3 years thereafter. In line with this review schedule, the Board proposes to increase the threshold again in 2015 in response to changing industry characteristics. Existing regulations with exemption thresholds, including regulations governing interest rate risk and liquidity contingencies, will be reviewed either in conjunction with the RFA threshold review or in NCUA's regular 3-year review cycle. |
