Title: Confidentiality of Information 
Abstract: This rule would revise regulations that address confidentiality of information requirements necessary to implement the National Marine Fisheries Service' (NMFS) interpretation of certain provisions of the Magnuson-Stevens Act. The rule would address the requirement to maintain the confidentiality of observer information, a new exception which allows for the disclosure of information submitted under catch share programs, and the meaning of business of any person. This rule also seeks to balance the purpose of the confidentiality mandate with exceptions that authorize disclosure of information to advance fishery conservation and management, scientific research, enforcement, and transparency in fishery management actions. In addition, this action is informed by other statutes that NMFS administers including the Endangered Species Act, the Marine Mammal Protection Act, and the Freedom of Information Act.
