Title: ●Modification of Nationwide Permits
Abstract:

The U.S. Army Corps of Engineers (Corps) conducted a national programmatic Endangered Species Act consultation on the 2012 nationwide permits with the National Marine Fisheries Service. The National Marine Fisheries Service issued a biological opinion on November 24, 2014. In one of the protective measures in that biological opinion, the Corps is to conduct rulemaking to modify four existing nationwide permits to add pre-construction notification requirements for proposed activities that result in permanent fills that add impervious surface cover to watersheds inhabited by listed species under the jurisdiction of the National Marine Fisheries Service. The four nationwide permits proposed to be modified authorize fills in jurisdictional waters and wetlands associated with utility lines (NWP 12), bank stabilization (NWP 13), linear transportation projects (NWP 14), and boat ramps (NWP 36).
