Title: SAMHSA User Fees for Data Requests 
Abstract:

SAMHSA receives funds from Congress to collect and analyze substance abuse and mental health data to carry out its mission. Beyond this responsibility under the statute, SAMHSA has been responding to data requests from outside interests that request data runs and analyses that are not critical to the accomplishment of SAMHSA’s mission but do help other government entities, researchers and the public understand behavioral health needs and outcomes.  SAMHSA is proposing to implement a modest cost recovery program (user fee) to offset the costs of above and beyond” data requests. The regulations would delineate what are considered to be data requests that are above and beyond” and what the costs would be for those services before any user fee was established for such runs and/or analyses. By collecting user fees, SAMHSA would be able to expand data request services provided to the general public. With the user fee in place, appropriated funds used for these data requests would be less and the user fee would provide the funds to manage and operate the process of responding to these data requests.
