Title: Affordability Determination-Energy Efficiency Standards (FR-5647-N-02) 
Abstract:

The Energy Independence and Security Act of 2007 (EISA) establishes procedures for the U.S. Department of Housing and Urban Development (HUD) and the U.S. Department of Agriculture (USDA) to adopt revisions to the 2006 International Energy Conservation Code (IECC) and ASHRAE 90.1-2004, subject to (1) a determination that the revised codes do not negatively affect the availability or affordability of new construction of single and multifamily housing covered by the Act, and (2) a determination by the Secretary of Energy that the revised codes "would improve energy efficiency." This Notice announces HUD and USDA's determination that the 2009 IECC and (with the exception of Hawaii) ASHRAE 90.1-2007 will not negatively affect the affordability and availability of housing covered by the Act. As of July 2013, 32 States plus the District of Columbia, Puerto Rico, the U.S. Virgin Islands, and Guam have already adopted the 2009 IECC, its equivalent or a higher standard for single family homes, and 38 States plus the District of Columbia, Puerto Rico, the U.S. Virgin Islands, and Guam have adopted ASHRAE 90.1-2007, its equivalent or a higher standard for multifamily buildings. The remaining States committed to adopting these codes under provisions of the American Recovery and Reinvestment Act (ARRA) of 2009. For those States that have not yet adopted either of these standards, this Notice relies on several studies that show that these codes are overwhelmingly cost effective.
