Title: Enhanced Weapons, Firearms Background Checks, and Security Event Notification [NRC-2011-0018] 
Abstract:

The proposed rule would amend the Commission's regulations by implementing the new authority in section 161A of the Atomic Energy Act of 1954, as amended, for access to enhanced weapons and associated firearms background checks, and would modify physical security event notifications at power reactor facilities, at-reactor Independent Spent Fuel Storage Installations, and Category I strategic special nuclear materials facilities.  There is significant public interest in this rulemaking because one of the authorities allowed under Section 161A is the authority to use certain weapons that would be otherwise prohibited by other State, local or other Federal laws (known as preemption authority).

Additional Information: As discussed in the 2011 proposed rule, the Firearms Guidelines is a joint policy document between the U.S. Department of Justice and the NRC that forms the basis for this rulemaking. After discussions with the Department of Justice, the NRC decided to update the background check requirements in the Firearms Guidelines. This update is complete, and the NRC will publish a second supplemental proposed rule containing the updated background check requirements in 2015, for public comment.
