Abstract:
DoD, GSA, and NASA issued an interim rule amending the Federal Acquisition Regulation (FAR) to implement a section of the Consolidated Appropriations Act of 2014, that prohibits the award of contracts using appropriated funds to any foreign incorporated entity that is treated as an inverted domestic corporation or to any subsidiary of such entity. The FAR is updated to require yes/no representations. The FAR is also being updated to require a contractor to promptly inform the contracting officer, in writing, in the event the contractor becomes an inverted domestic corporation or a subsidiary of an inverted domestic corporation during the performance of the contract. |
