Title: Amendments to Exempt Systems of Records (3817P) 
Abstract:

The Privacy Act requires agencies to maintain a system of records that allows individuals to gain access to his or her record or any information pertaining to him or her. The Privacy also requires each agency that maintains a system of records to promulgate rules to establish procedures for the disclosure of records as well as publication in the Federal Register a notice of the existence and character of the system of records upon revision. We are required to publish in our regulations a list of those systems of records that are exempt from disclosure.

We established our current system of records in 1975 and later updated it January of 1997. Experience and technological upgrades have allowed us to develop improved systems of records. Accordingly, we propose to amend 20 CFR 401.85 to clarify and update our list of exempt systems of records. These changes will allow us to improve our procedures for protecting the privacy of individuals as well as the exchange of records as required under the Freedom of Information Act and the Privacy Act.
