Title: MAP-21 Civil Penalties Interpretation | |
Abstract:
This rulemaking would provide interpretation for the added civil penalties factors in MAP-21 in determining the amount of civil penalty or compromise under section 30165 of the National Traffic and Motor Vehicle Safety Act. MAP-21 directs NHTSA to issue a rule providing an interpretation of the penalty factors. This interpretation of the penalty factors is based closely on the language of the statute, and informed by the agency's experience in its day to day enforcement activity, and the manner in which the agency has compromised penalties in the past. This rulemaking would also provide procedures for NHTSA to follow in determining the amount of civil penalties. These procedures are modeled after NHTSA's past practices with respect to civil penalty actions for violations of other statutes enforced by NHTSA . NHTSA is providing procedures for determining the amount of civil penalties or compromise so that civil penalties can be assessed efficiently and in a manner consistent with the requirements of due process. |
