Title: Phthalates Rule | |
Abstract:
Section 108 of the Consumer Product Safety Improvement Act of 2008 (CPSIA) prohibits certain phthalates in children's toys or child care articles. The CPSIA establishes a Chronic Hazard Advisory Panel (CHAP) to study the effects on children's health of all phthalates and phthalate alternatives as used in children's toys and child care articles. The CHAP must prepare a report and make recommendations to the Commission regarding phthalates identified in section 108 of the CPSIA and phthalate alternatives. No later than 180 days after receiving the CHAP's report, the Commission must promulgate a final rule pursuant to section 553 of the Administrative Procedure Act. The CHAP's report was received on July 18, 2014. In accordance with the direction in section 108 of the CPSIA, the Commission published an NPR in December 2014. On March 13, 2015, the Commission voted unanimously to publish a Federal Register notice to extend the comment period 30 days. The notice published in the Federal Register on March 20, 2015, extending the commend period until April 15, 2015. On June 23, 2015, the Commission published a notice of availability in the Federal Register for a staff document regarding assessments of NHANEs data sets, with a comment period closing on August 17, 2015. After reviewing comments, staff will prepare a briefing package on a Final Rule for Commission consideration in FY 2016. |
