Title: Regulatory Flexibility Act Threshold 
Abstract:

The Regulatory Flexibility Act (RFA) generally requires Federal agencies to determine and specifically consider the impact of proposed and final rules on small entities. Under the RFA, NCUA has authority to define what credit unions qualify as small entities and receive special consideration in the rulemaking process. In 2013, the NCUA Board (Board) increased the threshold it uses to define "small" for purposes of the RFA from $10 million to $50 million. The Board simultaneously committed to review the threshold within two years of the increase and every three years thereafter. In line with this review schedule, the Board has proposed to increase the threshold again in 2015 to $100 million in response to changing industry characteristics. Existing regulations with exemption thresholds, including regulations governing interest rate risk and liquidity contingencies, will be reviewed in NCUA's regular 3-year review cycle. After having received and considered the public comments, NCUA is moving towards finalizing the proposal.
