Title: Further Amendments to 2013 Mortgage Rules (Regulations X and Z) 
Abstract:

In January 2013, the CFPB issued final rules implementing numerous provisions of the Equal Credit Opportunity Act, the Real Estate Settlement Procedures Act, and the Truth in Lending Act, as amended by title XIV of the Dodd-Frank Wall Street Reform and Consumer Protection Act.  The CFPB has since made various corrections, clarifications, and other amendments to the January 2013 final rules.  Certain provisions of the rules took effect in 2013, and the rest of the rules took effect in January 2014.  The CFPB continues to conduct further analysis to consider possible amendments as warranted based on the CFPB's monitoring of the market and implementation of the Dodd-Frank Act requirements.  The CFPB released a notice of proposed rulemaking on certain limited issues in spring 2014 and published a final rule thereunder on November 3, 2014, to provide certain adjustments to its rules for certain nonprofit entities and to provide a cure mechanism for lenders seeking to make "qualified mortgages” under rules requiring assessment of consumers’ ability to repay their mortgage loans where the mortgages exceed certain limitations on points and fees.  In addition, the CFPB published an interpretive rule titled "Application of Regulation Z's Ability-To-Repay Rule to Certain Situations Involving Successors-in-Interest" on July 17, 2014.  Further, the CFPB, in January 2015, issued a notice of proposed rulemaking in connection with certain provisions that modify general requirements for small creditors, including small creditors that operate predominantly in "rural or underserved” areas; the final rule was published on October 2, 2015.  The Bureau also continues to assess possible additional guidance that would facilitate the development of automated underwriting systems for purposes of calculating debt-to-income ratios in connection with qualified mortgage determinations and other topics.
