Title: ●Requirement for Nondiscrimination Against Beneficiaries Under USAID-Funded Contracts  
Abstract:

USAID seeks to ensure that assistance provided under [the Foreign Assistance Act of 1961, as amended (FAA)] is provided to people without regard to distinctions irrelevant under a given award. Accordingly, the U.S. Agency for International Development (USAID) is issuing this rule to amend its Agency for International Development Acquisition Regulation (AIDAR) to expressly require USAID-funded contractors that they must continue to comply with the scope of work requirements incorporated into awards and must not discriminate against beneficiaries and potential beneficiaries in the implementation of those USAID awards. USAID will not be limited in their ability define scopes of work to target assistance to certain populations if the requirement is justified and if so defined and mandated in the award. Contractors are bound by these scopes of work and may not otherwise discriminate against beneficiaries and potential beneficiaries based on any criteria not stated in the scopes of work.
