Title: ●Modification of Regulation Regarding Written Argument in Antidumping Duty and Countervailing Duty Proceedings  
Abstract:

The Department of Commerce (the Department) proposes to modify one regulation by adding a new section and slightly amending others pertaining to written argument in antidumping duty and countervailing duty proceedings (19 CFR 351.309) and is seeking comments from parties.  The purpose of this proposed rule is to modify the Department’s regulations pertaining to written argument to add word limitations to case and rebuttal briefs filed with the Department. To administer the various sections of the Tariff Act of 1930, as amended, the Department allows interested parties and Government agencies to submit written argument including case and rebuttal briefs in its antidumping and countervailing duty proceedings.  Although the regulation establishes time limits and specifies content for case and rebuttal briefs it does not currently limit the length of such briefs.  The modification would impose a total limit of 25,000 words to be used by a party between its case and rebuttal briefs and identifies which portions of such briefs are to be included in the word limit and how attachments to such briefs are to be counted.  An additional modification is to add the words or countervailing duty to 351.309(b)(1) and 351.309(c)(1)(iii) to conform those provisions to 351.214(k) entitled Expedited reviews in countervailing duty proceedings for noninvestigated exporters.
