Title: Resource Agency Hearings and Alternatives Development Procedures in Hydropower Licenses 
Abstract: The National Marine Fisheries Service, the Department of the Interior, and the Department of Agriculture jointly revised the procedures they established in their November 2005 interim final rules for expedited hydropower trial-type hearings and alternative fishway prescriptions pursuant to the Energy Policy Act of 2005. Under that Act, hydropower companies may challenge the National Oceanic and Atmospheric Administration fisheries fishway prescriptions in trial-type hearings and can suggest alternative fishway prescriptions. The rules were published as interim final rules with the opportunity for public comment partly in response to a request by interested parties to provide their input on how the rules could be improved based on their experiences over the past few years.
