Title: ●Fisheries off West Coast States; Tribal Usual and Accustomed Fishing Areas | |
Abstract: This rule implements a 2015 judicial decision stemming from litigation between the Makah, Quinault, and Quileute tribes regarding the boundaries of their tribal fishing rights. The court expanded the boundaries for the usual and accustomed fishing areas for the Quinault Indian Nation and the Quileute Tribe. The rule will revise the regulations that describe the Quinault Indian Nations and the Quileute Tribes usual and accustomed fishing areas, and make related revisions and organization changes to tribal regulations, including regulations pertaining to West Coast Groundfish Fisheries, Coastal Pelagic Fisheries, and Pacific Halibut Fisheries. This rule has no proposed stage because it makes mandatory technical changes to the geographic boundaries of the tribes' fishing grounds per court order. NMFS has no discretion in implementation of the order and the rule does not treat other substantive issues. | |
