NMFS intends to amend regulations to be consistent with language contained in Inter-American Tropical Tuna Commission Resolution C-02-03 (Resolution on the Capacity of the Tuna Fleet Operating in the Eastern Pacific Ocean (Revised)) adopted in June 2002. Resolution C-02-03 provides opportunities for up to 32 U.S. vessels to fish in the eastern Pacific Ocean for a trip that does not exceed 90 days in a single calendar year. These vessels, per the resolution, must be authorized and licensed under alternative international fisheries management regimes to fish in areas of the Pacific Ocean other than the Eastern Pacific Ocean (e.g., the Western and Central Pacific Ocean). NMFS initially implemented Resolution C-02-03 on April 12, 2005, explicitly referencing the South Pacific Tuna Treaty as the only international fisheries management regime that would qualify vessels for the exception. At that time, the South Pacific Tuna Treaty was the predominant alternative international fisheries management regime. Since then, however, the Western and Central Pacific Fisheries Commission has been established. The amendment will provide additional opportunity for U.S. purse seine vessels, while making the regulation consistent with the language and intent of Resolution C-02-03. This action will alleviate an unintended restriction.
