Title: Reissuance and Issuance of Nationwide Permits
Abstract:

The U.S. Army Corps of Engineers (Corps) issues nationwide permits to authorize specific categories of activities in jurisdictional waters and wetlands that have no more than minimal individual and cumulative adverse environmental effects.  Nationwide permits cannot be issued for a period of more than five years. The issuance and reissuance of nationwide permits must be done every five years to continue the Nationwide Permit Program.  Currently, there are 50 nationwide permits, and those nationwide permits expire on March 18, 2017.  In addition to proposing to reissue some or all of the 50 existing nationwide permits, the Corps may also propose to issue new nationwide permits to authorize categories of activities that are not authorized by the existing nationwide permits the Corps proposes to reissue. This action is for reissuing or issuing nationwide permits that would go into effect on March 19, 2017, to authorize regulated activities over the subsequent five years. The revisions to this rule will be reported in future status updates as part of DoD's retrospective plan under Executive Order 13563, completed in August 2011. DoD's full plan can be accessed at: http://www.regulations.gov/#!docketDetail;D=DOD-2011-OS-0036.
