Title: Seizure and Forfeiture Procedures | |
Abstract:
The U.S. Fish and Wildlife Service proposes to amend our regulations that establish procedures relating to property seized and administrative forfeiture under various laws we enforce. This revision is intended to provide uniform guidance for the bonded release, appraisement, administrative proceeding, petition for remission, and disposal of items subject to forfeiture. Also, we intend these revisions to provide for greater consistency of Service seizure and forfeiture procedures with those of the U.S. Customs Service. We published our proposed rule in 1995. In August 2000, the Civil Asset Forfeiture Reform Act (CAFRA) became law. Because CAFRA mandated many changes to 50 CFR 12 that affect our 1995 proposal, we will publish a second proposed rule. |
