The Department of Homeland Security, U.S. Citizenship and Immigration Services (USCIS), and the Department of Justice, Executive Office for Immigration Review (EOIR), are planning to propose to amend their respective regulations to implement section 235 of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008, which provides new provisions for unaccompanied alien children in asylum and immigration proceedings. Through this joint rule, both Departments are proposing to amend their separate regulations to reflect that USCIS has initial jurisdiction over any asylum application filed by an unaccompanied alien child. The Departments also plan to propose to add new special procedures for unaccompanied alien children in interviews before asylum officers and in proceedings before immigration judges. In addition, EOIR plans to propose amendments to its regulations governing the relief of voluntary departure for unaccompanied alien children in removal proceedings.
