Title: Municipal Separate Storm Sewer System General Permit Remand Rule 
Abstract:

The EPA's Phase II stormwater regulations detail, among other things, how the nation's 6700 regulated small municipal separate storm sewer systems can obtain authorization to discharge under an available general permit. This action would finalize modifications to the regulations for municipal separate sewer system NPDES permits to address a U.S. Circuit Court of Appeals for the Ninth Circuit remand (EDC v. EPA, 2003). The provisions that are the subject of the remand concern requirements for the use of small MS4 general permits.
