Title: Employment in the Excepted Service 
Abstract:

This final rule clarifies the existing policy on exemptions from excepted service selection procedures, and provides additional procedures for passing over a preference eligible veteran. This amendment is necessary to ensure that the regulations conform to the requirements of 5 U.S.C. 3320, as interpreted by the Federal Circuit in a precedential decision. Agencies will be required to use the same pass-over procedures as are used in the Competitive Service; Selection from Certificates statute.
