Title: Nondiscrimination Based on Disability in Federally--Assisted Programs; Updates to HUD's Section 504 Regulations (FR-6257) 
Abstract:

Section 504 of the Rehabilitation Act prohibits discrimination on the basis of disability in all programs and activities receiving federal financial assistance.  HUD issued its regulations implementing Section 504 in 1988 and has not updated them since.  HUD sought public input in an Advanced Notice of Proposed Rulemaking (ANPRM) published on April 25, 2023 on ways it can update its Section 504 regulations and its Section 504 accessibility standard for HUD-assisted facilities in order to ensure that individuals with disabilities have equal access to all HUD-assisted programs, activities, and facilities, such as public housing, affordable housing, homeownership programs, homeless shelters, and disaster recovery programs. HUD has applied the Uniform Federal Accessibility Standards (UFAS) or the HUD deeming notice, which allows the use of the 2010 ADA Standards for Title II of the ADA with a small list of exceptions, for purposes of its Section 504 accessibility standard. This option to use the Deeming Notice exists until HUD formally adopts an updated accessibility standard.  HUD intends to issue a Notice of Proposed Rulemaking that will propose an adoption of an updated Section 504 accessibility standard and offer proposed revisions more generally to account for advances in accessible design, information and communication technology, and assistive technologies.
