Terms of Clearance: Approved in accordance with Section 1320.13 of the regulations implementing the Paperwork Reducion Act. The Department is requested to take particular care in responding to public comments in order to show the impact on recordkeeping resulting from alleged changes in current commercial practices. We particularly note comments such as those alleging the proposed regulations do not adopt the WTO Agreement on rules of origin with specific procedures for origin determination or criteria mentioned in the Customs Service's January 3, 1994 publication; comments that the rules conflict with other regulations governing the country of origin marking of home textile products, disrupt commerce and industry in violation of NAFTA, and broaden the definition of textiles and apparel; and comments that allege that the proposed regulations would cause enormous disruption for United States and foreign producers of home textiles and made-up textile articles.

Abstract: The information, which is provided by the foreign assembler and the importer, permits Customs to determine whether imported articles which were assembled abroad with components cut to shape in the U.S. from foreign fabric are eligible for a duty exemption for the value of the components.
