<p>The Rural Housing Service (RHS) is seeking to publish a final rule to implement section 4024(c) of the CARES Act and to align with the Housing and Urban Development&rsquo;s (HUD) anticipated proposed rule on a 30-Day Notification of Nonpayment of Rent. USDA&rsquo;s rule will amend 7 CFR part 3560 to require that sections 515, 514 and 516 Multi-Family Housing (MFH) program borrowers provide tenants with written notification 30 days prior lease termination or eviction action for nonpayment of rent 30-day notice,&rdquo; regardless of the existence of national emergency or the availability of emergency rental assistance funds. This rule would also require that the 30-day notice provide instructions on how tenants can resolve the lease violation of nonpayment of rent, which would include, but not be limited to: the amount of rent owed, the last date to pay the rent amount owed before eviction or termination of lease takes effect, and instructions on how to request income recertification. Additionally, this rule provides that, in such circumstances as presidential declared national emergencies, the Secretary may require that MFH program borrowers provide tenants with other specified information to prevent eviction for the nonpayment of rent.</p>
