A proposed rule was published in the Federal Register on September 29, 2016 (81 FR 66866) to codify Supplemental Nutrition Assistance Program (SNAP) issuance provisions of the Food, Conservation and Energy Act of 2008, Public Law 110234. Since the publication of the proposed rule, the President signed the Agriculture Improvement Act of 2018 (2018 Farm Bill). Section 4006 of the 2018 Farm Bill made various changes to the provisions governing the storage and expungement of benefits. Section 4006 specifies that a State may take benefits off-line after 3 months (previously 6 months). States must expunge unused benefits after 9 months (previously 12 months). States must also send a notice to households before expunging benefits. FNS intends to adopt the proposed rule as final with changes reflecting Section 4006 of the 2018 Farm Bill, providing States two expungement options, and providing greater clarification regarding the off-line process.
